This book explores Australia's ambivalent legal and political response to 'irregular' migrants including: asylum seekers, "boat people", "illegals", "queue jumpers", and "economic migrants".
It documents the essential facts: how many people arrive, who they are, where they come from, and why they come.
The book addresses the complex system of refugee law and policy and the extensive changes since Tampa in 2001.  It covers both the introduction of the "Pacific Strategy", and the changes proposed in May 2006 to address Indonesian concerns over refugees from West Papua.
It examines the mandatory detention of unlawful non-citizens and reports on living conditions in the detention centres.  It explains key High Court decisions confirming parliament's power to detain a person indefinitely - in breach of international human rights law.
Australia's experience, law and policy are compared to that of other countries in some key areas.

About the author
Mary Crock is an Associate Professor and Associate Dean (Post Graduate Research) in the Faculty of Law, University of Sydney.  She has worked in the area of immigration and refugee law since 1985.
Dr Ben Saul is a Lecturer in the Faculty of Law at the University of NSW and an Associate of the Australian Human Rights Centre.
Azadeh Dastyari is an Assistant Lecturer at Monash University and a member of teh Castan Centre for Human Rights Law.  She has taught International Refugee Law at Monash University and Immigration and Refugee Law at the University of Adelaide.
